Are these applicable to FanDuel also, since Fanduel and Draftkings are tied at the hip since the last expose of their employees swapping info?
There was a real issue. I'm surprised individual lawsuits took so long. I did a Fanduel/Draftkings blog expose a couple of years ago, right after the courts forced them to offer single-entry events so as to reduce collusion between their employees, who were out to exploit the public.

Here's the link to my old blog entry. You can track down the original NYTimes piece.
Note: to this point in time, for context, I am down about $1500 on Fanduel lifetime, covering all sports. My Draftkings lifetime tally is within a hundred dollars either way

For individuals who have lost significant money on DraftKings, particularly over $75,000, several law firms are currently involved in litigation and investigations. The legal strategies often center on allegations of predatory marketing, deceptive promotions, and enabling gambling addiction.
Law firms to consider
Loevy + Loevy: Actively representing plaintiffs in class-action lawsuits against DraftKings in multiple states, including Pennsylvania and New York. They claim DraftKings uses deceptive practices and exploits users, especially through promotions like "risk-free bets".
AVA Law Group: Investigating and representing victims of the alleged "DraftKings VIP gambling scheme". Their focus is on how DraftKings targets high-risk gamblers with misleading promotions and aggressive VIP host tactics.
Morgan & Morgan: A large personal injury law firm that has been involved in litigation against DraftKings and FanDuel. While many class-action cases have been forced into individual arbitration, the firm can help users navigate that process.
Goldwater Law Firm: A firm that discusses the options for gambling addiction lawsuits, including multi-district litigation (MDL). This may be relevant for individuals with large losses who could potentially receive more compensation than in a class action.
AboutLawsuits.com (Investigating firms): This site tracks and connects users with law firms handling sports betting addiction cases. Many of these investigations focus on young adults who lost substantial amounts of money after being targeted by addictive apps.
Legal arguments being used
Lawsuits against DraftKings generally allege the following:
Predatory Practices: DraftKings allegedly targets individuals with gambling addictions and exploits them to maximize losses.
Deceptive Promotions: Lawsuits claim promotions like "risk-free" bets and deposit bonuses are misleading due to hidden terms and conditions.
Ignoring Responsible Gaming: Some cases allege that DraftKings ignores self-exclusion requests from users with gambling problems. For example, one plaintiff who asked for their account to be closed in 2019 was able to continue gambling for four more years and lost over $350,000.
VIP Host Exploitation: In one suit, a wife accused DraftKings of targeting her husband, who had a gambling problem, with incentives to fuel his addiction.
Important considerations
Mandatory Arbitration: A court decision recently upheld DraftKings' mandatory arbitration clause, which is in its terms of service. This means that instead of joining a class-action lawsuit, users may have to pursue their claim individually through arbitration.
State-Specific Laws: Legal options and success rates may depend on your specific state's consumer protection laws and whether the alleged predatory practices violated them.
Evidence is Critical: Any emails, screenshots, or other records documenting your interactions with DraftKings, your VIP host, or misleading promotions would be valuable evidence for a lawyer.

Whenever you see a law firm advertising on Facebook regarding how you "may be entitled to compensation" for something that occurred, ignore it.
They're just attempting to fact-find and gather evidence/data.
You don't need to do their job for them.
Let them contact you if you're part of a class.
However, this one may be different, as it is only targeting those who lost over $75k, and it has to be done via individual arbitration. Some of these firms might be willing to represent you on contingency for an amount that large.
I think it's great that the records-keeping of DraftKings will be used against them. By forcing people to have monitored accounts (like being tracked via a players' card) rather than anonymous individual step-to-the-window transactions, they will be hung on their own petards.
To this day, neither DraftKings nor Fanduel publicize the economy of scale payouts that go to the cartels playing thousands of entries. If they did, the public could see that 10% of the players get 80% of the money (or thereabouts) for the contests that are not "single entry."
