It's really nasty.
Basically they're saying, "We get to track you by default because it's online, and we can determine quickly if you're a winning player or a loser, by your betting style. If you are destined to lose, we keep you. If you have a shot to win, we get rid of you."
I wish this were illegal. If it's only 1%, how bad can it be for them? It's not even like their lines are competitive in many cases.
Oh, and I like author David Purdum. I have his phone number. He's a great contact if you want something in sports or gambling covered. He was the one who covered the BetMGM bank theft scandal, which I investigated and broke open in October 2022. His ESPN article was what forced BetMGM & their payment processor Global Payments into action to stop this.
