Note to Todd / Dan Druff

In a thread on here, the poster known as kewlJ has stated that I didn't pay for the house at 1412 Forest Dale Lane, Johnson City, TN 37604.

Now this is provably, clearly a lie, especially as I just had Regions Bank due a complete history of my title while we bought another house. I have kept the Forest Dale Lane home for the moment, although we moved to Bristol directly across from the Speedway. So there is no question I bought the house and paid for it. I still own it.

Now if you are not going to correct him regarding this, I'm afraid I need to take action.

If you provide an email and/or physical address, I will have Regions email you the title history of that home, actually dating back to the previous owner, as we bought it from a friend of mine, an author with a book coming out next year (about the Bell Witch).

You really should not be allowing this. After the season, I need to have a sit down with you regarding a lawsuit. Somebody running a site called Poker Fraud Alert should not allow anonymous posters to make provably false claims about property ownership. Those are very specific provably false declarations.

Surely you understand that anyone claiming ownership of a property is making a legal claim and anyone disputing that ownership is also making a legal claim.

I also have an issue with this kewlJ poster making declarations regarding at what point in time I announced as a sports handicapper. He seems to be claiming that I was trying to "fool" people. Since I ran a full page ad in 1980 GamePlan magazine stating unequivocally that I'm a sports handicapper, and since GamePlan sold more than a hundred thousand copies of that magazine, I think that my position as a sports handicapper was quite public and clear.

Please send your email address to IntegritySports@aol.com so we can get this legal ball rolling. I suggest a get together in Las Vegas sometime in December or January if you want to straighten this out. I'm willing to spend a fair amount to clear my name on this, so let's get the facts clear and documented.

I mean, c'mon, you are running something called Poker Fraud Alert and allowing this? That's terrible. You are allowing an anonymous poster to lie about someone's personal financial history with the intent of doing reputational damage. It's the definition of defamation.

The only thing the least bit new and interesting to come from Redietz's rant, was his revelation that he placed an ad in Game Plan Magazine declaring himself a sports bettor. I had to look Game Plan Magazine up. It is one of those many publications that previews football. Now why would a person run a full page ad declaring "I am a sprot bettor"? A real sports bettor, that is a person who bets sports and makes a profit doesn't need to declare I am a sports bettor. He just does it. Did Billy walters run an ad declaring he is a sports bettor? :confused:

Let's also address this Dan Druff and PFA stuff. You have to wonder if Redietz has even once visited PFA, if only to read for a couple minutes. The shit that is posted there makes this place look Mother Teresa's diary. The guy that goes by Dan Druff likes this kind of shit! :D And you can't shame him about it. Failure in real life is living off your kids in your retirement. While there are many that find themselves in this kind of multi-generational living arrangement it is almost always a result of a poor financial situation, as is the case with this Rob Singer character.

I don't understand what redietz is trying to do here.

First off, while nobody enjoys being sued, I have dealt with numerous lawsuit threats while running my PFA forum, and I never let these intimidate me. Ironically, the one time I was actually sued, I was not threatened with any litigation. One day I just discovered that I was part of 12 defendants in an extremely frivolous action for $330 million (lol). I hadn't even been served. I won that one before it even went to trial, btw.

Anyway, I assume redietz is trying to say that he's going to sue kewlJ, and he needs my cooperation in the matter.

If that's not what he was trying to say, then he can clarify.

Regardless, here is my response to this and any other talk of lawsuits here:


1) I am protected by Section 230, a federal law which is part of the Communications Decency Act of 1996. This is a federal law that provides legal immunity to online platforms (like this one) for content posted by its users. Therefore, I am not held liable as the "publisher or speaker" of third-party content. Anything written by a user here is content which belongs to the user (the site ToS even clarify this), and I am simply running the platform where it's written.

2) I take the user privacy on my forums very seriously. I will never give out personal information, email addresses, IP addresses, or anything else unless there is a court order or warrant to do so. I will not cooperate with any civil subpoenas for such info, and will fight any attempt to get such info this way. The only exceptions involve people who have credible allegations of having committed mid-level-or-worse crimes (including scamming), or those who have maliciously harassed or harmed me or this forum (trolling/bashing me doesn't count, nor does mundane breakages of forum rules resulting in a ban). For everyone else, I will fight very hard to keep personal info private.

3) I know very little about kewlJ. If I had a gun to my head, I couldn't tell you who he is. I have verified before that his IP address resolves to a local Vegas IP, and it's not a proxy or VPN.

4) While kewlJ has been a whiner, a liar, a hypocrite, and a pain in the ass on many occasions, I will protect his personal information, unless you can show me that he is a criminal (and not just by hearsay or guessing).


It is important for an AP-heavy forum to be very protective of people's personal information. I have no problem with redietz, but I am also not going to be forced or pressured into handing over anyone's personal information. If an attorney contacts me, I will tell him/her the same thing.

I've read your excuse before of, "I'm an AP, I have to misdirect in order to protect my identity", but that's nonsense. You throw in a lot of extraneous details which don't really misdirect -- they just pile on additional crap which serve no purpose other than to bring more attention to your tales.

For example, let's say I got mugged at a park near my house, and I wanted to tell the forum about it, but didn't want to give away where I lived.

I might change the location of the park, or even the city where it happened. Maybe I'd even morph the date. This way if people attempted to scour police reports, they wouldn't find it, and therefore not be able to pick up information I'd rather not make public. However, let's say I were to throw in additional details like, "Oh, and then after stealing my wallet, these thugs had their friends climb into my upstairs window, and threaten that if I end up pressing charges, I'm dead!"

That might make for a sensational story which would get more attention, but it wouldn't obfuscate any details about the actual crime. If caught lying about the latter, I couldn't say, "Well, I just did that to protect confidentiality!" That wouldn't make sense.


It seems fairly clear to me that you're a guy who loves drama. You can make quality posts when you want, and you're not a stupid person. However, sometimes you can't help but insert fibs into your postings, and sometimes they're not very believable fibs, and the entire thing comes crashing down.

While I have only had one similar case early in the life of the internet I am far from expert, but I submit the following purely for shits and giggles: I think it is "probably" accurate.

Let's say MDawg files a defamation action in KJ in California, and that he has the money to take it where ever it may lead.

His silk stocking attorney, a specialist in internet cases, issues a subpoena in the originating California court requiring you / your provider (if then known) to disclose info as to KJ's identity and location, i.e. his internet address, and also the identity of the host of your board, if not readily apparent.

MDawg's mouthpiece, clever barrister that he is, then follows the steps set forth in The Uniform Interstate Depositions and Discovery Act (UIDDA) to have a subpoena issued from a Nevada court.

How it works: An out-of-state attorney who has a valid subpoena from their home state can submit it to the clerk of a Nevada court to get a subpoena issued by that Nevada court. The Nevada court clerk then issues a local subpoena for service on the Nevada-based person or company.

The subpoena is then served.

Now here's where it gets murky for me: I don't know whether serving you and your host, standing alone, would allow the lawyer to learn KJ's actual physical address; if not then a new subpoena would be issued directing the entity (which you / your host would have to identify pursuant to the subpoena) which actually hosts KJ's internet account to provide his address for service of legal process.

The second subpoena, if needed, is then served.

Note: I doubt that your host / provider would dare to fight any valid civil subpoena: why would they care about your interest in protecting others?

Failure to comply with a validly domesticated subpoena can result in consequences such as contempt of court, fines, or other penalties

Addendum to my post above about subpoenas:

The analysis would apply only if MDawg didn't know what state KJ lives in, i.e. let's say he wanted to go after keystone or another anonymous poster whose location is unknown to him.

KJ lives in LV, so the hound should be able to file a defamation action initially in Nevada, KJ's home state, instead of filing first in California, which I assume to be the hound's home state.

He'd then have his attorney issue a subpoena out of the Clark County court without the extra step / hassle.

Well I have zero legal training, but I don't believe I can be automatically compelled to give up any IP/email info via a civil subpoena. They can try, but I can fight it, citing user privacy concerns. Otherwise anyone can get anyone else's info from any online platform by just filing a bogus suit, subpoenaing the target's info, and then dropping the suit.

My point is that I would fight any attempt to do this. I wouldn't just hand the stuff over.

I would not refuse any US-based court order. Once that were to occur, yes, I'd have to give it.

I should note that I do not have kewlJ's physical address nor real name, so there's nothing to give on that front. IP addresses can be connected to physical addresses, but only via kewlJ's ISP. I am not sure how the ISPs treat this. I'm assuming they don't give any of this up unless they get a law enforcement request, or a court order.

The subpoena would ultimately be seeking his IP, and it would be provided by his ISP, not you.

But the subpoena would be issued to you for you to give to your message board host, unless counsel can determine that ahead of time in which case you'd probably not be involved.

Failure to cooperate voluntarily would result in them filing a motion to compel: they'd win and the objector would be ordered to pay their attorney fees and costs.

Oh.... I think you're confused about something.

There is no "message board host". I am the message board host. In fact, that's how I became an admin here in the first place.

Here is my timeline on Alanbestbuys/Vegascasinotalk:

March 2013: I show up as a regular user to talk about the Caesars Total Rewards program.

Mid-2013: I notice a ton of spam and other technical issues here. I then come to realize that Alan doesn't even have email verification turned on, because his message board host is so shitty that it got its IPs blocked from most mail servers.

October 2013: I offer to Alan to move the entire forum to my PFA server, and to technically administrate it going forward, while leaving the actual forum moderation to him. In exchange, he agrees to pay a very nominal sum of money to help contribute to the cost of the PFA server. I do this, and keep to my end of the bargain. I wipe out all of the spam, turn on email verification, and basically solve all of the technical problems here.

February 2016: Alan calls me and says he wants to shut down the forum (due to someone making legal threats against him regarding the forum -- how ironic!) I tell Alan that I enjoy the forum and don't want it shut down, and offer to take it off his hands. He agrees, and gives it to me (because he was otherwise turning it off anyway), under the condition that I change the URL and name of it. That's how VegasCasinoTalk was born. He announces that the forum was "sold" to me, but in reality it was sold for $0.

November 2022: Alan passes away. Had this transfer not occurred, the forum would likely be gone anyway, even if he hadn't taken it down in 2016.



Anyway, I answer to no host. I lease a bare metal machine (meaning it's a physical unit and I'm not sharing it with anyone else) to host all of my sites. The buck stops with me.

I have a Master's Degree in Computer Science, and worked in that industry through 2003.

That's why the people attempting to attack this forum (weirdos from WoV, spammers, etc) have been completely shut down. Remember that one guy who didn't like that some dude named "LarryS" registered here, and demanded I ban him, or he was going to spam/harass my forum until I capitulated?

I told the guy to eat shit, and I banned him. Then he was trying to make good on his threats, registering accounts and trying to dox LarryS, while spamming this forum. I very quickly shut off his ability to register accounts here. He was dumbfounded, because registration was still turned on, everyone else could make accounts and instantly post once they verified email, but his attempts to register were all thwarted. He tried hundreds of times and couldn't figure out how I was doing it. He tried VPNs, proxies, and all kinds of other ways. Eventually he gave up. I guess he might have gotten some minor satisfaction that he did cause LarryS to voluntarily run off anyway, even though I refused to ban him. But the guy disappeared because his attempts to destroy the forum (or even inconvenience it) were met with utter failure.

I wrote custom mods into the software to look for certain "signs" it was him, and then ban his new accounts before he could finish registration.

Anyway, I don't need no stinkin' message board host.

By "host" I mean the person or entity which collects and stores the postings from and the ISP's of all who post on your board.

The message board host is the person or entity which a subpoena can compel to release the ISP of the target.

I went to google / AI, it said: "A message board can be hosted by a variety of entities and systems, including
commercial hosting companies, specialized forum hosting sites, individuals, and software platforms."

If you do it yourself then yes, it would be directed to you only, apparently, which is unfortunate as nobody else will be there to help you "fight" your losing battle: you'll almost certainly want to "lawyer up" unless you choose to go pro se.

Legitimate Advantage players and Pro Sports betters generally don't want to use their real name when talking about Advantage play stuff, including sports or whatever it might be, as it leaves admitted evidence of what you're doing, and that you're winning with a legitimate strategy and an advantage. It can come back to haunt you.

However, if you're not really winning, then I guess it doesn't matter.

The fact that Red chose to use his real name was nothing more than a gimmick to entice investors and to tout. A good salesman would say," It's okay, I'm using my real name, I must use it legit because you know a lot of those other guys don't use their real name when they're trying to screw you."

Yes, I'm the host. I don't own the physical machine where this site resides, but I lease it and they basically give me free reign of the full machine and the internet connection to it, and I'm the one who maintains everything, including all the server logs. They only get involved when there's a physical hardware failure of some kind.

As I mentioned earlier, I will fight any attempts anyone makes to subpoena information from this or the PFA forum. I will only comply with US-based court orders or warrants. And in the case of law enforcement requests, I'll use my best judgment regarding the level of cooperation. (If it seems the person is credibly accused of a crime, I'll probably give it up.)

In the case of redietz, I don't understand the big deal. Nobody cares whether or not he owns his house. I definitely don't.

Some sportsbettors do not engage in typical AP stuff, so they don't have much to hide. Some of the most successful sportsbettors have been public with their name, especially because they've already been severely limited by all books in town, so at that point there's no point to hide their skill. In many cases, they can leverage their success into tout services, seminars, or promotional opportunities. Such publicity also makes it easier to enter bearding arrangements with high-limit degens, who are more willing to trust them. Note that bearding is legal, but it can get tricky when the degen doesn't stick to the plan and shoots off the profits.

I cannot imagine a scenario where you'd be requested to respond to a subpoena duces tecum (or its equivalent) issued by a court in Nigeria, for example: certainly you should ignore such an attempt.

I believe that there is a process for foreign litigants to follow but it involves having a new subpoena issued in the USA, in your case in a Nevada court, similar to how an out of state subpoena would be reissued.

As for criminal cases: other than the subpoena specifying the information requested I wonder whether you have a right to be told anything about the state's motivation / likely criminal charge?

Again, this is not an area of law I am familiar with, but what if they are investigating and no charges have yet been filed?

What if it's a matter of National Security?

My point: it may not be easy or even possible to protect anybody without putting yourself in harm's way / stepping into a pile of dung; you should definitely consult with an attorney who is up to speed on such matters before taking action.
