Justin Mills wins Maryland live case

I just read at WoV where, a decision is in on the Justin Mills vs Maryland live, illegal detention/false imprisonment case. For anyone unfamiliar Justin Mills, a card counter, was illegally detained by Maryland Live and then the local police.

Congrats to Justin and Attorney Bob Nersesian. It certainly seemed like a open and shut case with Maryland Live providing the video needed as evidence, but you just never know if justice will actually be served. In this case it was. In addition to the damaging video provided by Maryland Live, Justin was clearly an invited guest. They sent a limo to pick him up. :rolleyes: The award amount ill be determined by a jury, but based on similar cases I would expect no less than 6 figures. I hope the jury really punishes Maryland live.

In addition, and this is the best part, the judge found that the two police officers involved acted on behalf of Maryland Live rather than their authority as police officers. Both police officers held second part-time employment at Maryland Live at the time. I remember when I saw the video, the one police officer erroneously quoting the law to Justin. Both Officers may be held liable for their actions...which is great!

Do you know if he also filed suit against the police? Hopefully he files a civil suit against them also.

Yes, he has a civil suit against both officers. The officers in turn filed a counter suit against Justin alleging they were damaged and embarrassed when he released the audio that he recorded of the conversation and interaction with the officers. The countersuit by the officers was thrown out. Justin's civil suit against the officers remains.

I would say it's to bad that Maryland Live had to learn the hard way. But it's actually good that they learned the hard way not to mistreat people. It's looks like getting backroomed has a lot of +EV to it these days.

So many of these new jurisdictions came about in such a hurry over the last 10 years, I don't think the casino personnel, right up to the top executives, know what is legal and what isn't. And that same learning curve applied to law enforcement in these jurisdictions.

And I am not only speaking of back-rooming and illegal detaining, but even back-offs and barings. Often the state legislature or governing body, thinks they decide these things (barings and backoffs) as opposed to New Jersey/Missouri law where they are not allowed. So they "think" they have established law but they haven't until it is challenged and a judge (and appeals) rule in their favor.

I don't follow all the new jurisdictions, but one I have been following is Pennsylvania, because I lived their before moving to Vegas, and return there twice a year and still play there. Pa thinks they have the right to backoff and ban players, because their legislature said so. I don't think they do. I have been waiting for someone to challenge that. It would be an interesting ruling since the state right new door has long ruled casinos can not ban players. That would serve as some precedence.

It really isn't a win type situation if someone were to win such a case, as the state would then resort to countermeasures that still amount to an unplayable game (like New Jersey does). That is probably why no one has bothered.
