Thread: Bank of America $35 Late Fee

    I was just hit with a $35 late payment fee from Bank of America on a credit card payment.

    I made the payment on the due date using my Bank of America checking account, but BofA says they could not "post" the payment until the following day because it was made in the evening.

    I protested and said that the payment was made prior to midnight on the calendar date that the payment was due and the payment came from a Bank of America checking account. It's my feeling that Bank of America should be able to immediately record the payment when the checking account is from their own bank -- not a foreign bank.

    I was told it could take as long as "two days" to credit a payment from a Bank of America checking account to a Bank of America credit card by Daniel Webb of their customer service department.

    The payment, by the way, was for $205. The $35 late fee is 17% of the amount I paid.

    I find it absurd that a big bank such as BofA which has online banking can't post a payment from a checking account with Bank of America to a credit card with Bank of America immediately when the payment is done through Bank of America's own online banking system.

    I asked Bank of America to drop/refund the $35 late fee and they refused.

    Alan, that happened to me with Capitol One last month. I called at 10pm to make a payment due on that day, Friday. They told me it wouldn't be posted until Monday and that I could be subject to a $35 late fee. They made me say that on a recording and I also added that I was paying the day it was due and "they" wouldn't post payment until Monday.

    I also put this on my Facebook page and I am amazed at the number of people who have had similar experiences. Is this worthy of class action?

    Alan, did you ask for a supervisor?

    Bottom tier reps at these call centers are often not empowered, and even the ones that are tend to be stubborn.

    I would press this further, if I were you. Try calling back and asking for a supervisor. Even if you did last time, try again, as this varies from person to person.

    This time, tell them that a rep told you in the past that as long as you use the website and pay with your B of A checking account, it posts the same day. Put the error on their reps, even if not true.

    Good luck. I have done very well removing late charges in the past from credit cards, even when it was my fault. I have only failed once, and it was right after the credit crisis of 2008, and banks were very obnoxious regarding exceptions then.

    I went through three "levels" at BofA and none of the three people I talked to would remove the charges. They all rejected the argument that I made the payment on the calendar day using a BofA checking account through their own online system.

    I asked them to send me a letter from their legal department spelling out exactly what their reasons were for refusing to remove the late fee. I was told to expect the letter within ten days. I really want to see just what they put in writing.

    Asking for legal department letters won't do much, as they always have some fine print to cover their asses.

    I suggest you try one more call with different people (not mentioning you failed the first time) before giving up. You should threaten to cancel the card if they won't reverse it.

    So far three failures. I need that letter before attempt #4. I am hoping that the letter addresses that I made payment from a BofA account that they did not post till the next day.

    BofA has to recoup losses from all those credit cards they gave out to illegal aliens in Calif. a few years ago. And leave it to Dan to again jump right on another financial loss/"unfair treatment" issue with all the experience and vigor of the world's most disrespected person.

    Just let it go Alan. Why do you waste your time with such borderline issues? Just set your win goal up forty bucks on your next Rincon visit and have the last laugh. And don't go dumping your card over this. That's what losers end up doing and it is only they who suffer more over such actions. Understand the policy and abide by it going forward. Banks, like casino hosts, are NOT your friend, and they simply utilize their customers for a profit. Most methods are normal & expected; some are purposely sly. You have to expect things like this at times, esp. with all your experience.

    I am not going to do a thing with BofA over this $35 charge until I get that letter that was promised to me. I hope that letter will have the smoking gun that I will need to go to federal and state banking regulators.

    On another issue: my mail order pharmacy -- in error -- billed my BofA debit card for a prescription I did not order. I immediately called the mail order pharmacy who recognized the error and said not to worry, because the order had not yet shipped and the "charge" would "drop off" my card within 48 hours.

    Well, three days later the charge did not drop off my card and actually went through my BofA debit card account.

    So this morning I called BofA and they immediately filed a dispute and issued me a CREDIT on my debit account to cover the incorrect charge. THEN I suggested that we both call the mail order pharmacy and find out why the mail order pharmacy screwed up -- and yes, the BofA rep arranged a conference call.

    We (BofA and me) got the mail order pharmacy on the line and the mail order pharmacy revealed that instead of cancelling the charge to my debit card, they KEPT the money and put it into my account as a CREDIT -- when they should have just cancelled the charge like they were supposed to do.

    That BofA rep was on the phone with me for close to an hour. I think I got my $35 worth.

    About five years ago, I sued Scotia Bank... here in Canada.

    For $3.

    Well, on the day of the trial, the judge was no where to be found. The clerk finally tracked him down to the funeral of a lawyer freind.

    He got to court at about 5:30 pm. There was a case ahead of ours on the docket. At 6:30, I was on the witness stand. I had a lot written down. After cross, etc, the judge went for a 15 minute break to check the case law. It was 8:30 pm.

    I lost. I don't know, maybe $200 in filing fees, and travel.

    The other side asked for $20,000 in counter suit court fees. (Two lawyers, and two upper management banking employees, had to wait all day.)

    The judge threw their counter suit out. Likely because they weren't very forthcoming during the trial.

    I walked 500 ft. over to the nearest casino, made back my $200+. Stayed at a friend's place, and left for home the next day.

    By the way... I still haven't received that promised letter from BofA.

    Should add that I've actually enjoyed a 98% success rate in court over many types and degrees of personal trials. Not exactly a "loose canon".

    Have beaten billionaires, and a casino...
