Pretty good article explaining this stupid lawsuit, and the reasons for it.
JSTAT's video above is interesting because it shows how quickly the people on the outside areas of the concert started running -- long before anyone closer to the stage started moving. Maybe they had a better perspective on what was going on?

This is a narrow issue.
Originally I'd assumed MGM would argue that the court should declare that there is no basis anywhere to hold them liable; now I see they are asking the court to declare they have no liability based on the company having hired a security company approved by DHS.
I have to assume their attorneys have researched the issue and have compelling arguments lined up in support of their position.
At least I sure as hell hope so for their sake, because it will prove a PR disaster for MGM if the suit fails and the myriad of cases proceed forward as it will have put MGM in a bad light, which you really don't want to do when the stakes are this high.

As long as you received equal to or beyond the general standard of care.....there is no basis for collecting damages. Results are not guaranteed
If some agency approved the type of security they had, and other casinos has the same type secirity or even lesser security....then again there is no guarantee of results.
NOW based on the past shooting...the "standard of security care" may go up. But that would be going forward.
Just as in medicine the standard of care keeps going up as we learn more and refine procedure in favor of patient safety. So in vegas the standard of security care will keep going up as we learn more and see more.
It all hinges on ..is what MGM says true? Did they have proper security on par with the standard. If true..the they are home free.
ButI will say this. I dont see them hiding behind the standard of only having room checks every 24 hours....that seems to be a pretty shaky "new standard"......and i cant see them legally hanging their hat on this and only this as the answer should another attack occur....and some casino is pointing to these measures as proof of compliance
Room checks are only the beginning. It's a new Vegas. Caesars has been using bomb sniffing dogs. Wynn has been opening luggage at the valet. Cars will be inspected. IDs will be checked more frequently (note that APs).
The PR nightmare continues.
