Thread: Selling www.CaesarsCasino.Vegas

    Since I am no longer blogging about Caesars Palace (heck, I haven't been there in more than 11 months) I've decided to sell the URL (website address) www.CaesarsCasino.vegas and I am selling it thru an auction on eBay.

    The URL auction has a starting bid of $400.

    All kidding/trolling aside, I suggest you take that auction down, Alan.

    You may not be aware of this, but CaesarsCasino.vegas could be confiscated at any time by Caesars itself. Their lawyers could easily file a UDRP resolution complaint and reclaim the domain.

    In order for a UDRP domain resolution complaint to succeed, the following must be proven:

    1) The domain name registered is identical or confusingly similar to a trademark or service mark in which the Complainant has rights
    2) The existing domain owner has no rights or legitimate interests in respect of the domain name
    3) The domain name has been registered and is being used in bad faith.

    Looking at this, Caesars could easily prove all three.

    Clearly "CaesarsCasino.Vegas" is confusingly similar to a trademark Caesars currently holds.

    You do not have legal rights to own anything related to the name "Caesars", especially given that the "casino" and "Vegas" parts make it even clearer.

    This is being used in "bad faith" -- basically attempting to get traffic based upon the well known brand of Caesars in Vegas.

    If you were to sell this to anyone, they could get it confiscated, and Caesars could even go after them for legal fees.


    I'm being serious here.

    I would end this auction now, and in fact let the domain go when the time comes for renewal.

    I know a lot about these domain registration resolutions because I was on the other side of one in 2006.

    A cybersquatter named Eric Parkinson registered toddwitteles.com just a day after I won a WSOP bracelet in 2005.

    I attempted to get it back from him. I was able to prove two of the three elements (opportunistic bad faith registration and the fact that Parkinson had no rights to "Todd Witteles"), but I could not prove I had a trademark on my name (because I didn't). I attempted to instead prove that I had a "common law mark" based upon my then-notoriety as a poker player, but I failed.

    I actually put together a pretty damn good complaint for someone who isn't a lawyer, but there was simply no way to prove the trademark/common law mark thing, so I was screwed.

    I got back toddwitteles.com years later, due to an oversight on Parkinson's part.

    I had never met Parkinson before, but I had an extremely weird encounter with another guest at the Rio front desk in June 2018. A man there recognized me, and identified himself as a huge fan of my radio show, and proved it by telling me lots of details about the show, including the episode I had just broadcast. It turned out that man was Eric Parkinson!

    All kidding/trolling aside, I was going to ask if that domain could have an issue, I was almost certain it could, however, I just assumed Alan (the investigative reporter) knew more than me about this sort of thing.

    Lesson learned, I can only ever assume Alan knows more about losing in casinos and stiffing family members than I do.

    Did the guy ever make money with that domain name or maybe he got it just to sell it?

    AlanBestBuys.com isn't worth anything to anyone besides Alan, much like toddwitteles.com isn't worth to anyone besides me (and Eric Parkinson, I guess).

    If this were closer to when AlanBestBuys forum became VegasCasinoTalk, I would have been interested in the domain just for continuity's sake, but not anymore.

    Thanks for your expert opinion Dan Druff but alanbestbuys.com has real revenue from advertising. Even when I retire I could keep the site up and running and let the advertising continue.

    I'm not going to debate the merits of CaesarsCasino.vegas but there is no trademark on CaesarsCasino and it is not a parked domain and there has been real content on it for two years. This particular domain was one that the "other company" chose not to register. They did register other obscure domains ranging from CaesarsPalace.vegas to even OctaviusTower.Com.

    It doesn't matter if they have a trademark on Caesars Casino specifically.

    They have a trademark on Caesars, which is a casino in Vegas. That would be enough to win the domain back.

    That's where "identical or confusingly similar" also comes in. Just because you can find a variation of the company name to where they hadn't technically trademarked that exact wording doesn't mean that you can get away with cybersquatting their domain.

    Trust me, Caesars could easily take that back if they wanted.

    Well Dan it's been around for two years. And they haven't made a peep yet. If they want it now they could write me a letter or place a bid. I'll keep you posted.

    I guess they could go after SevenStarsInsider.Com by your reasoning, too.

    I don't believe Alan is cybersquatting. He hasn't attempted to shake down Caesars for any money, and I believe he really just thought it was a good website address to get attention to his blog.

    I don't have a moral issue with him buying that domain, but just stating that Caesars can easily take it back when they want to, and if the buyer of the domain ever makes the site popular, Caesars will snatch it back.

    Actually Caesars would have more trouble trying to "snatch it" the longer the site operates and the more content that is added to the site and the longer it's maintained as a legitimate business.

    I'm surprised I haven't been questioned yet about my use of the name "Best Buys" considering the giant retailer uses the name Best Buy. Well I have an answer for that too. I used Best Buys and Best Buy on TV years BEFORE the Best Buy electronics retailer started in business-- and they know it.
