Thread: Indian rip-off

    So a guy comes up to me at the race track and says you have to help my friend. I ask him what the problem is. He says his friend won a $150,000 jackpot at an Indian casino and they refused to pay. They basically told him that they are sovereign and exempt from the laws of the state and can do whatever they want.

    Anyone have any experience with being scalped at an Indian casino?

    I don't think there is any reasonable recourse.

    Which Indian casino? Let's take a look at them. Bad publicity is what usually gets them to pay off.

    I haven't met with the guy cause I don't want to waste my time. So I don't know which casino. My assumption is there is no legal means to force a payout. I can't bill him for bad pub. But if anyone knows of a legal process I am all ears.

    Hi regnis:

    If the Indian Casino has a management contract with an non-indian enity, like Harrahs or Stations, you could go after the management company in regular court.

    Don't we need to know the particulars? What bet was won? Why wasn't it paid? What proof the bet was made, won and denied? And so forth?

    All I know is it was a slot jackpot and they just said they don't have to pay because they can do whatever they want. I can only assume the guy at the track got the truth from the alleged victim. Again, I don't want to waste my time if there is no recourse. If all I can do is go to the Indian counsel then I'm not getting involved. If, as FAB suggested, they are affiliated with a name brand, then I might get more info.

    I really doubt a casino would not pay a machine jackpot of $150,000. We've seen stories on the news about machines that malfunctioned and a payout of eight million was falsely displayed on a machine that had a top jackpot of ten thousand... but $150,000?

    I'd like to see something more substantial before I even believe it's true.

    There are a lot of rumours in this world. And in casinos. LOL

    This happens at least once a year at the Indian casinos around Phx. Last happened at AK chin, and even though it's in the CET system of casinos, the Indians always have the final say. No, they do not do whatever they want because the Indians are also good businessmen. People regularly take them to court for coming up with reasons why the jackpot was not valid, and they lose or infrequently, settle.

    Only idiot lawyers take tribes to the regular courts: duh.

    Tribal casinos are owned by Indian tribes which are, in the context of this discussion, sovereign nations and as such immune from the usual civil court system.

    Most use this as a shield; they will enter into compacts with states and local jurisdictions for some things, but rarely if ever will they give up their immunity from outside civil liability as imposed by our court system.

    There is an option, and that is to pursue the claim in tribal court.

    That is probably his best bet; he should also make sure the news people know about it so that the negative publicity acts to help promote settlement outside of the (kangaroo) tribal court system.

    Then again the guy who claims he was victimized could be full of shit: without knowing the facts little can be said or done other than as I suggested.

    Do you guys stay up late at night thinking about what bullshit story you could come up with and post it here without a single bit of evidence it even took place, except for what some guy you don't even know said?

    Seems like a lot of lawyers belong to these sites. Do you guys hang around hoping for something you could get your hands on like ambulance chasing lawyers? Business must suck if you were forced into gambling and belong to sites like this.

    You said you don't think there is any reasonable recourse. You're the fucking lawyer, do your own research. I'm sure you know where to look.

    I say, BULLSHIT to this homegrown story.

    Lawyers typically depend on LOCAL clients; this board is national /international.

    Speaking for myself, I gamble for fun, not to earn money; what makes you think anyone or anything "forced" me or anyone else "into gambling?"

    As for joining this site, that too was a purely voluntary decision not brought on by need, desperation or anything other than an interest in Las Vegas and gambling in general.

    I post at other non-gambling boards as well: my interests are myriad.

    Blackhole is right. It probably is just bullshit. Remember about 15 years ago there were all those stories about people getting drugged and then waking up in a Vegas hotel room with a kidney missing? People swore up and down "it happened to a friend of my friend" and so forth and the truth is the Las Vegas police said there was NEVER a single case of this happening. In fact the only time it happened was in a B-movie which came out shortly before all those rumors.

    As I said when I posted this, a guy came up to me and asked me to help his friend. I have no facts and wasn't going to meet with the guy until I even knew if there was any course of action that I could take on his behalf.

    Whether it actually happened is not important nor is it the question that I asked. What I asked is, if it did happen, does anyone know whether there is anything that can be done since it was at an Indian Casino. I have no idea if the guy was cheated or not as I don't want to even meet with him if I can't help him.

    As to Blackhole, yes I am a lawyer. I handle estates and trusts. I couldn't get you out of jail if I had the key!! I do also have a little side order of gaming law on my resume but am in no way an expert on this type of matter. So I asked the question here of various types of gamblers and "experts". No---I am not going to waste my time researching it. And isn't that what this type of Forum is supposed to be about--the exchange of information?

    So again, is it bullshit? I have no idea but that wasn't the point.

    Try National Indian Gaming Commission, an agency of the U.S. Government, to resolve any issues or disputes with respect to the operations of the establishment(s).
