Rule 14 of an October promotion

...This company.... "may exclude anyone from participating in the promotion for any or no reason, at management's sole discretion"

the for no reason is the part i question.... How can they exclude someone for no reason? Doesnt that open it up to discrimination? Hey that person is black, I dont like blacks, exclude them.

I left the company out, wasnt sure if I should include it or not.

Does this line open it up to lawsuits if an AP were to get excluded, just claim some form of discrimination?

Yep, that does seem like it is begging to be sued for discrimination. Horrible idea IMHO

Welcome to the world of casino promotion rules. That is a pretty standard clause. They constantly change the rules midstream when they realize someone is getting the best of something. Reserve all rights

    100% legal.

APs are not a protected class. Racial and religious groups, for example, are.

You don't like blacks? There's a thread here called Hate Speech. Just make sure you're not a black Jewish homo cripple before you start reading.

In Nevada, casinos can legally bar anyone for any or no reason as long as it's not discriminatory against a protected class. They can (obviously) bar blacks, but the reason can't be because they are black.

It's kind of a two-way sword, as they say. On one hand, we'd obviously like it if we could play with impunity and not ever get 86'd or removed from a promotion. OTOH, if that was the case, then there would be very few (if any) playable promotions. At the end of the day, the casino has to be able to make money in order for us to make money.

What about that court case from Jerrys Nugget, where casino tried to 86 a card counter went to trial and the judge ruled due to public property laws you can not 86 a patron unless they are being "disruptive or disorderly"?

I'm not sure what happened there but Bob Nersesian said that this rule does not in fact hold.
