    MrV,

    I'm sure folks can look it up on their own, but as the resident lawyer, could you comment on the definition and legal credibility of sworn affidavits? Thanks.

    An affidavit is a written statement made under oath to be used as evidence.

    False statements in an affidavit, as with false statements in a sworn declaration, can lead to a criminal charge of perjury.

    It is hoped that people will be "more honest" in a formal affidavit than they would in their everyday, non-sworn statements.

    Yeah, good luck with that.

    In my years of practicing I've never seen someone locally conviceted of perjury, and there's a shit-load of lying in courts.

    Yeah, shocking.

    Once day I was in court waiting my turn to argue a motion, and I watched two lawyers arguing to the judge; the position of each was diametrically opposed to the other, with completely different claims being made.

    Toward the end the judge slammed a book to get their attention, glowered at the two lawyers, and said "I am sick and tire of people coming into my courtroom and lying. Now continue."

    Not affidavit related, but down memory lane...

    A Portland lawyer represented a teen age girl, age 16, in a personal injury case.

    He had a good result for her and invited her to "celebrate" their victory; she agreed.

    He rented a limo, together with limo driver, and spent time with her, tootling around stumptown.

    At the end he bragged to the limo driver that he plied her with alcohol and then had sex with her in the limo; unbeknownst to the horn-dog shyster the driver was an off-duty cop, moon-lighting.

    Open bottle, open fly, open mouth...oops.

    Redeitz, I apologize in advance for hijacking this particular thread. If you feel the need, request that Druff remove my post. But I want to issue an opinion, related to this whole matter, which you have asked for privately.

    You are wasting your time (hopefully not much money) on this. It may very well be that you have a legitimate case and can prove that Rob's statements that you or someone on your behalf solicited him and that he is repeating this claim against you, a real and known person with a reputation in the world of sports handicapping has indeed damaged your reputation and mayby cost you business (and money). But these cases are just an incredible hard case to bring. Especially when the damage done occurs on the internet. Right or wrong...that is the fact of it. The internet and all these forums are a breeding ground for fueling these kind of lies and attempting to damage someone's credibility or reputation. IT is what many of these forum have become about. The only person that can stop it is the person that owns or runs the forum and in almost all cases that person enjoys that type of behavior.

    Maybe it will someday change. And maybe lawsuits and substantial financial judgements to those who engage in this behavior is what is needed to make that change come about. I don't know. BUT, YOU aren't going to get that from Rob. Whatever money you spend on Attorneys and depositions and everything, even if your case is cut and dry, you will end up with some C.B equipment and electronics from the 80's. And Rob will continue to laugh at what a dick he is all the way to the poor house.

    Actually, Rob can't even afford the poor house, so he mooches off his kids. That is and was his whole retirement plan. Mooch off his kids. That is all anyone need know about this Robert Argentino, degenerate losing gambler, who posts as Rob Singer, gambling fictional writer. The best action anyone and everyone can take is not legal action, but to just ignore him. He is irrelevant and should be treated as such.

    I've operated for 45 years with an absolutely pristine reputation. I've never even exaggerated anything I've done in any presentation in ads, in person, on forums. It has been 45 years of Dragnet facts. So when I say that nobody has ever solicited via phone for me, that is the unabashed truth. I'm 64 years old. I don't really care if I win one cent for this or that. I've set aside 20k that I'm willing to donate in pursuit of truth, and when that's used up, I'll reconsider the situation. Odds are, I'll continue.

    I'm not interested in "winning money." I'm interested in getting the facts straight. My word is sacrosanct in this business. I am settled in to pursue this in a measured, precise fashion for years, and that is what I will do. I am going to appeal to Todd Witteles to provide a physical address once again. Otherwise, I will post the pertinent information publicly, both here and at Poker Fraud Alert.

    Interestingly, the legal waivers one signs at PFA, I did not sign here when I joined under Alan Mendelson.

    I can appreciate everything you just said, redietz. I feel exactly the same way. Yes, I use a handle KewlJ instead of my real name. Most AP's do and everyone understands why. BUT, in the AP community, especially here in Las Vegas, which is really a small town dynamic (especially the AP part), many AP, knew my name and who I am even before I was recently doxxed. And many more might not have known me by real name but knew my face. THAT is the way it works!

    I was warned a long time ago, that participating on these forums was detrimental and possibly very damaging for an AP. This is real damage. Financial as well as to reputation. An Ap's reputation is everything. I know for a fact that a number of AP's have sort of backed away from me over the years. I am not the kind of AP's that teams up and participates in plays with other AP's, but I know for a fact some that would not have an interest because of things said about me on forums. At least one TOP AP here in Vegas has stood by me though. He is a funny guy, critical of me many times, but when I have needed a little help he has been there offering a play that he isn't playing or a bit of team play.

    You have no idea the well meaning friends that have given me the "I told you so" over the past few months.

    That forums make you sign not to hold them responsible is very telling. And not to single Shackleford out but his behavior with the Mdawg situation has made it clear none of these guys, even once respected Math and AP guys have little interest in the truth now. They care about the number of view at their site every day. And as long as that is the case, then the truth ceases to exist. We all live in Mdawg, or Rob Singer's fantasy world.

    Redietz, if you want to sue "Rob Singer" for defamation or other legal theory then have at it.

    I believe his statements, if false, would probably be actionable.

    You are not a public figure.

    But I suggest you run it by an attorney knowledgeable in this area and not a general practitioner.

    You know Rob's real name but not his address (you'll need his address to serve the lawsuit); you get the address by having your attorney subpoena the info via Dan Druff and his internet provider.

    Then file, serve, and be prepared to spend a shit load of money.

    Odds are he's judgment proof, but hey you never know.

    Your call: to sue, or not to sue: that is the question.

    But no empty threats, please: either fish or cut bait.

    I've already gotten legal advice. To sue or not to sue Rob Singer isn't the primary concern. My reputation is my primary concern. I will be sending affidavits to Todd Witteles regarding my 45 years of business practices, if he provides a physical address. If he does not, I will post them here. Then, if Mr. Argentino wants to match those affidavits saying they are false, we'll have at it. If anyone want to publicly state that those affidavits are not truthful, we will have at it. If that requires acquiring names from Mr. Witteles, then that's what will happen.

    Whether Rob comments on the affidavits or not has no bearing on your current right to sue, but I'm sure you know that.

    Do not go in expecting Dan to cooperate and voluntarily give you Rob's address: expect to get it via subpoena, if at all.

    Seems to me you aren't ready to sue, you just want to throw oil on troubled waters; the damage, if any, has been done, I see no need to go the affidavit route; but that's just me, a divorce lawyer, not a "specialist."

    If that's what your lawyer suggested then yeah, go for it.

    But keep in mind that repeated threats of litigation made to an internet antagonist which are not acted up on make the claimant look like an ass.

    Not saying you're at that level ... yet.

    But if it gets to a court Rob should subpoena Kewlj to testify as an expert witness on Rob's financial situation. KJ tells us about Rob's finances all the time, like he is an expert on it. Kewlj can tell the court how Rob doesn't own anything of value so redietz is just sucking wind. LMFAO!

    But you can bet your ass redietz thinks/knows Rob is worth a lot of money. Or he wouldn't be going after him.
    Challenge to redietz. We bet every NFL regular season game. You make the picks. If you lay the fav I get 2 extra points. If you take the dog I get a 2 point discount. Easy pickings for you.

    Or it could be he's just "fed up" and has enough extra time and money to throw at the problem.

    Most defamation cases are filed "for the principle of the thing" with little expectation of substantial recovery.

    So, if he sues and gets a judgment for a million bucks Rob can thumb his nose and say "Find the money if you can:" there is no obligation for people to pay off judgments against them, i.e. there is no civil or criminal penalties for that.

    Let me again say this about that: I too have to laugh. And if I had a belly then it would be bouncing around during the reading.

    I'll try to get this correct--which is always difficult due to the "level of weird" in redietz' posts.

    Red wants to sue me for my reporting here that I received several sports betting solicitation texts/calls several years ago, where the sender(s) dropped red's name as their source?

    And he's worried that THIS has ruined his, eh-em, reputation? Hold on for a second so I can giggle a little more.

    My curiosity asks, does poor red want me to LIE and say it never happened? In the absence of a time machine I can't provide evidence that it occurred. But, can he and his team of lawyers prove it didn't? Or...maybe somebody knows somebody who knows someone else from the tens of thousands of people who read forums, who decided to punk me and use redietz' name in the process because they know how much I look down on those who make money from selling picks instead of via betting on them.

    Do you see why this is just more redietz being just plain weird? Yes I'm always available between Az. and SD. But I ain't Chris Rock.

    The Ditz already has everyone's name, address and all other pertinent information on everyone over here already.
