From I've read he said nothing that a clever adjuster of defense attorney could use for a "gotcha" moment.

That depends on the facts, and in KJ's case the facts are strong enough to allow him to discuss it publicly in my opinion.

Just for historical record. There was a guy, who I believe is still a member at WoV, Justin Mills (jmills) or something like that (Hope that is the right guy), that was pursuing a case against one of the Maryland casinos about 5 years ago, who gave period updates as the case was going on.

And If I am not mistaken Mr Nersesian has spoken of cases as they were going on, including rejecting a question saying he didn't want to get into that at that time.

James Grosjean sometimes posts on forums or at least regularly did back in the mid 2000's. His case was just slightly before my time on forums, so I don't know if he spoke about it as it was going on or not.

I think I read some update as to the Mindplay player tracking technology case as it was going on back in 2006 when I first started on forums. That wasn't a casino abuse case, but rather illegal tracking og players type case.

I haven't been told not to say anything, although I do meet with attorney again later this week, but I just don't want to say something I am mistaken about and being that this is all very new to me, I probably would. I already did so yesterday.

Rob, I know you'll use every opportunity to flame and denigrate KJ, it's what you do, but there's no real need for him to wear a muzzle, even if he could.

It's the prudent thing to do V. Mouths ALWAYS get people in more trouble than doing things. In this case, the risk is a big payday. I'm all for kew getting a big check from a casino if his story is true. There is no upside to bringing this up on social media. None at all. Any ideas he might glean from us would/should have been covered in detail by his attorney. Whenever someone has an opportunity like this, the best move is to keep it to themselves. I did that in spades when finding and playing the DU anomaly. To me, silence is the best approach until the time is right.

Anyway, some people have messaged me that kewlJ's story is "definitely fake". It really is an interesting subject to consider, because it's not obviously fake or obviously true. I would neither have shock if the story were proven true, nor if it were proven untrue.


Here are the reasons kewlJ's story might be true:

- He names the casino (South Point). This makes it easier for people to debunk, if they have any connections there. If he were making up the story, he would probably not name the casino.

- The situation was not particularly dramatic or shocking. It's not like he got beaten up in the backroom for mouthing off. Instead, he was just shoved into a chair too aggressively, and fractured (not broke) his arm. Made-up stories for forums tend to be more dramatic (see Rob's fake $1.5 million hit at Resorts World).

- It is semi-reasonable that a card counter who wants to continue counting in Vegas under-the-radar doesn't want to engage in what could possibly be a high or medium profile lawsuit.

- It is bizarre that he claims to have had a "lawyer on speed dial" in the case he is a victim of casino security abuse, and then when an egregious, obvious case of it occurs, he does not want to sue.

- He claims that anonymity is part of the reason he's not suing, yet he could have sued without posting on the forums about it, and there's a good chance nobody would ever notice.

- Litigation rarely occurs in these situations where it's obvious wrongdoing occurred. It is highly likely the casino would settle, which would have completely kept his case under the radar. He does not address why he did not pursue it given this fact, other than a weak claim that he does not like being litigious. Obviously in a case like this, it would not be him being unnecessarily litigious.

- South Point apparently gave up the video of the incident too quickly and too easily, which contradicts others' experiences in similar cases.

- kewlJ has a history of hoaxes on other forums.

Come on man. It was 12 years ago. I was robbed at gun point and panicked. Thought it would help avoid a follow up incident if it was thought that I had passed. I made a mistake. Owned up from day 1. Never ran from it or returned to posting under a different name, which I could have done.

Once they had me step away from the table and it became clear I was heading to the backroom, I thought I would just be read the trespass act and sign a document and that would be it. No need to contact anyone. And I think that was what was supposed to happen. Someone just got too aggressive.

If I had it to do over again, I would have called the second they made me step away from the table. I would have made them stop me from making a phone call.

Numerous players like Grosjean, were detained, handcuffed, arrested and spent time in jail. Anything escalating to something like that would be reason to call the attorney immediately. I just didn't think this was that kind of thing and it wouldn't and shouldn't have been....until it was.

I was never kicked out (trespassed) at this location or any location before. I was backed off here before. Twice, I think. Come on JBJB, you know the difference between a back off and a trespass.

And one of those occasions a bicycle security guy told me to leave the property, but no one in real authority told me to leave, nor did anyone including that bicycle guard say anything to the effect that I could not return, which I had dozens of times since that incident.

Putting aside the entertainment portion of your post, this case has one more curious point: kew said he called Metro and gave a detailed statement. That's a police report. Those immediately get assigned a number that corresponds to claimant's name. If a crime has been reported then a detective is assigned to the case. This has nothing to do with the wishes of the claimant--it just gets done.

In the case that kew presents, a felony was committed by whoever broke his arm. Nothing can prevent the ensuing investigation. So we have to assume Metro is, or has been, busy working on this. That means they are talking to SP. Those of you who live in LV, as Dan alluded to, probably know someone who works there that might know about this. I talked to my contact but she works on the hotel side so her info is hardly absolute. But she did tell me it's a nothing burger so far.

The problem is, as I've stated, there is no police record of such an occurrence with kew being the claimant. That does not mean, however, that he won't file a complaint and, in fact, based on the report of events, he should.

Conclusion: This incident seems to be kew being kew. I suspect SOMETHING went down, but seeing the opportunity for a massive amount of forum attention, kew very likely embellished whatever happened. I also cannot believe an attorney like Nersesian would simply OK a client's choice to "just move on" especially after viewing the incriminating evidence.

The accusing words "roughed up" were used. With the result being a broken arm, that's assault, not an accident. Also, this is not a case where the assailant or his location are unknown....like when someone's tires get slashed overnight and a police report is made. Follow-up gets done in these situations.
