Right, a guy who knows all about the JG lawsuit and who claims to have Bob Nersesian in his phone and who already has an attorney thought it was a good idea to walk away from an illegal backrooming where they *broke his arm*.

This was what made that story the beginning of the end for KJ's forum life.

Plenty of people took for granted that your general story was true at this point, but the idea that you would not even talk to your attorney about it was crazy.

There had literally never been better grounds for an AP lawsuit to my knowledge (because of the broken arm). There was a guy killed in Reno but he was not an AP.

And no it wasn't just Axel saying this or some imaginary AP friend (or some actual AP that still believed you). Everyone was saying this, because it was so obvious.

It was really the broken arm that was the one detail that sank you. The idea of walking away from that (you even claimed an ambulance came for you!) is just nonsense.

I write this for MrV in the vain hope that it might spark a flash of insight.

Ok fine, a number of people on this forum, suggested I do something. Mickeycrimm and Dan Druff as well. It was agroup effort that convinced me. But Axelwolf and my AP friend were big to me. I value their opinion in this matter.

The ambulance came because as soon as I got out the front door, I called the ambulance. It wasn't because I couldn't have driven myself, I certainly could have. I just though even then before I knew what I might do, that I should have as much documented as I could.

You guys have always blown the fracture in my arm out of proportion. There are arm breaks that the entire bone break, sometimes coming through the skin and/or the arm dangles. Bone has to be reset and sometimes secured with rods or things. That is not what this was. This was a relatively small fracture of a bone in my arm. It just was basically an accident, but an accident of an illegal activity on the casinos part. It is NOT like they took me to the back room and intentionally broke my arm like in the movies. No Hammer.

Anyway, I don't want to reshash that part of it. I am allowed, but see no need.

That YOU or others may have handled it differently is irrelevant to me. My top priority has always been longevity as an AP. If I had gone through with a lawsuit, I probably would be done being able to play table games in this town. Doing it my way, I had an ok year last year even taking some time off and am heading towards a great year this year, with the sports betting going well, and blackjack machine play this spring. I am probably going to make that same money in 2.5 years. See the difference?

Ok, I will answer you. I had not decided anything at that point. So I called the ambulance so that there would be a record of where the incident occurred. I mean it doesn't prove anything but come on.

The next morning I called the attorney and the reason I did so is because I think, could be mistaken, but I think an attorney need to make a formal request that they hold or preserve the evidence (video) fairly quickly, within days or weeks. So I called him, briefly told him what occurred and he wanted to meet later that day.

He laid out some possibilities as far as action and I considered them for 2 weeks, going back and forth in my head. The incident occurred on a weekend and it was a full 2 weeks later, on a Sunday that I finally made the decision to not do anything. I posted the incident the next day. I also told the attorney of my decision. Within a few days based on no small part because of the advice of some people here, I changed my mind, called the attorney back and took a second meeting.

It was at this second meeting that I in no uncertain terms told him I did not want to go to court and asked if we could see what kind of settlement offer, if any would be received, which was something that came from Axelwolf. He said something about seeing what kind of settlement you could get.

So No, the night of the incident, I had not made up my mind about anything. I was pissed and try not to make decision spur of the moment when I am pissed. I did what I thought was best, which was to call an ambulance to the location of the incident.

While we are at it, I will tell you something else that I don't think I have said before...maybe I did but I don't think so.

My brother (you know my fake brother), can tell you how I struggled with the decision over those two weeks. I must have flipped back and forth 8 or 9 times. And the reason I kept coming back to maybe I should do something wasn't even about the money.

I kept coming back to that I had played for 15 years (14 at that point) in Las Vegas without ever receiving a trespass or baring. Not 1. Many backoffs, mostly polite, but nothing permanent. And the reason I enjoyed that good period was because of the legal actions taken by James G and several other players in the mid 2000's. It made the casinos understand that they couldn't do that backroom shit anymore.

So I felt some sort of obligation to do something. People can believe that or not believe that, but it is true. I wanted to do something, but didn't want the career damaging exposure. And when Axelwolf and others, but I think Axelwolf was the one for me, that suggested seeing what kind of settlement I could get, that seemed the best of all worlds to me. I might be able to hold someone accountable, get some money out of it and not damage my career too much. And it all worked out.
