Thread: Agua Caliente is actively stealing from players trying to play one of their promos

    ke6cdh started a thread about this on the West page, but this is serious enough that I felt it deserves a thread on the main page.

    Cliffs: Agua Caliente is advertising a promo where any hand pay gets a $500 bonus in freeplay every Wednesday from 5PM-10PM. Slots only, no VP.

    They are then refusing to pay said jackpots, (not just the promo money, but the jackpots themselves!) and trespassing players after first CONFISCATNG WHATEVER SLOT TICKETS THEY HAVE ON THEM.

    While I don't know the OP in the thread on the other site, I can state that I have independently heard of at least a half-dozen other AP's caught up in this. Undoubtedly some high-rolling squares are caught up in it as well.

    Sounds like the honey pot play Sun Coast (Vegas) put together to attack machine (VP) APs.

    Problem is it's an Indian Casino. They got their own laws.

    You can’t sue a nation. But I think nersesian has had success suing individuals in an Indian nation.

    It was legitimate for week 1, they got hammered by a certain AP and his wolfpack, and they've apparently been hypervigilant ever since.

    Aqua Caliente casino is in California. Bob Nersesian is admitted to the Nevada bar and not the California bar so he could not bring suit. Even then, it is one thing to sue an individual for such things as assault instead of the employer. Quite another to sue an Indian Casino for non-payment where presumably no Aqua Caliente employee has individual liability. I don't play in California Indian casinos unless there is a brand name such as Ceasars managing the casino which would be a legitimate target in court and not subject to sovereign immunity.

    Nersesian can and does work as a consulting attorney on cases in other states, just as he did in the Arizona case that I mentioned in my earlier post. While it's true that he can't stand before a judge and deliver on-the-record arguments in states other than Nevada, he can consult on any case he wants, anywhere,

    Why would you bother with an attorney who can't argue a case? That's California. There has to be a lot of qualified, hungry, knowledgeable gaming attorneys over there instead of hauling that guy into it.

    He specializes in representing APs against casinos. Not many lawyers occupy that niche, especially in CA where it's almost all Indian casinos which are especially unappealing defendants.

    That expertise is probably worth a lot.

    I know what he does, and he can't do it in California.

    Google is unavailing but I'm guessing it's not uncommon for a lead attorney to hire another out of jurisdiction attorney as a consultant.

    I can’t speak for every jurisdiction, but most allow an out of state attorney to appear in court by a process called an “appearance pro hoc vice”. This simply is the Latin for “for the occasion”. You hire a local lawyer to step up and ask the judge to allow for the out of state lawyer to appear “pro hoc vice”. I have appeared this way in a few states.

    Update. They called everyone to pay. Right after I did an interview for local nbc, the station called for comment and they immediately decided to pay, however they will not rescind the 86 and they are requiring a signature claiming you agree not to pursue any further lawsuits or claims. I refused and left them with the jackpot

    That's was my thinking in my original reply in this thread. Lots of players are going to be getting Lawyers for this shady Casino.
