DanDruff care to weigh in on UNKewlJ's backrooming lawsuit "story" now?

DanDruff we all know how much stock UNKewlJ places in what others think (a LOT). He has stated that you think he is credible…so, When you have time, why not take a look at the UNKewlJ backrooming lawsuit, and give us an informed, updated opinion on how credible UNKewlJ is now.

Some key points to consider:

1) He retracted his implying that this all happened at SouthPoint, which his naming the actual casino where this happened was one point you had originally mentioned that weighed in his favor as to whether any of this ever happened.

2) He stated that the case was filed and served, and said repeatedly that he had the case number:

3) As far as the settlement, there were at least two discrepancies there:

a) He reported about the signing of the settlement agreement on Juneteenth, a court holiday, on a Monday. He later deflected saying that well it had been signed other than on that day, but that somehow he was only told about it on the court holiday.

b) He reported that he received the settlement funds via ACH on a Saturday, a non banking day. This could not have happened that way.

4) Now, I searched carefully, both federal and state cases for Clark County, Nevada and found NOTHING, no relevant lawsuit.

so that told us that yes, MaxPen and I were searching in the right place, BUT, besides the fact that a false imprisonment battery civil case would almost never be sealed (his claiming that it was sealed was an obvious lie presented to try to explain why no one was ever going to find the case), what UNKewlJ didn’t realize, was that since 2008, the law in Nevada has been that even for sealed cases the full docket will still appear:

I did not use a search function. I reviewed every single day's docket. I did this because unless you know exactly who to search for you could get no results even if there was a case. I also reviewed a dozen or so potential cases by downloading the case summaries and filings.

Additionally, he continued to claim that he could not talk about the sealing “I can NOT get into this”, when the statute provides that the grounds for sealing, Anything related to the sealing, why it was done and who sought the sealing, would be public record. And, anything that is public record cannot be compelled to be confidential by agreement or otherwise.

Which brings us to other inconsistencies about the case and how he has discussed it:

1) That his arm was broken by simply being pushed into a chair “Brittle Bones” – as AccountInQuestion has put it
2) That the video was turned over to his attorney simply by request, before even a lawsuit was filed
3) UNKewlJ’s confusion over whether a judge did or did not sign an order to get the video (before any lawsuit was filed)
4) UNKewlJ’s confusion over how many days the casino had to respond to the lawsuit (UNKewlJ claimed 60, by statute it is 21)
5) UNKewlJ’s confusion over whether he was the plaintiff or defendant (he kept referring to the casino as Plaintiff), even after he supposedly signed a long settlement agreement where he would have been referred to as “Plaintiff” multiple times
6) Told us repeatedly in the past that he has attorney Nersesian on speed dial, and yet has gone out of his way to state that he has never named what attorney might be involved in this case
7) UNKewlJ’s confusion as to whether a judge was needed or not needed to approve the settlement agreement
8) UNKewlJ's confusion about what he could and could not talk about as the case was settled, and after:
a. Claimed he could not discuss what the settlement amount was, but at least three times off handedly implied exactly how much he has received
b. Claimed he could not name the casino involved, even though this is public record, sealed case or not
c. Claimed he could not reveal the case number to anyone, even though this is public record, sealed case or not

Seriously, when it comes to dealing with this convoluted, contradictory story, it is a headache just to make sense of it. It is a function of UNKewlJ’s twisted confused mind that none of it makes sense.

But the fact remains that there is no record of this supposedly filed and served lawsuit, and that UNKewlJ has refused to even provide the two cases he supposedly found that have nothing to do with his own case, where he claims that only a case number appears.

The UNKewl one was a liar, and like most liars, he was constantly changing his stories, altering time and personnel from one telling to the next. One time he would tell a story about someone, next time he would switch the story around to give himself the lead. Perhaps it's loosely based upon a real incident, such as a blackjack ban he received where a security guard roughly handled him and accidentally hurt kewlJ's arm a little bit. I don't think there was any incident which was lawsuit-worthy, which is why we got so many changing and bizarre versions of the same story.

I give this forum credit for tenaciously digging for details, especially MaxPen who went through all kinds of possible cases in the Eighth District Court! It is very difficult to lie about things in the internet age. Too many ways people can search out the truth, especially if they are good at critical thinking and are willing to put some time into it. This is the exact same reason Rob's whoppers have flopped here so badly, from the Newell to the huge video poker hit at high limits.

In general, if you have a story to tell the forum, be completely truthful about it. And if it's a story people are likely to doubt, be ready with receipts. If you cannot do either, then don't tell the story at all.

Actually, here, many, if not all of us, believe that he did this to try to back up his ongoing story about being a card counter. He wanted to appear like such a menace to the casinos that they were actively breaking his brittle bones just to dissuade him from reentering.

As MaxPen and the rest of us have pointed out, he has a habit of doing this, saying something or other, repeating it over and over, and then when feeling that his point isn’t getting across, offering some sort of document or person who will corroborate his story, but never actually producing the documents or naming the persons.

This case is sealed, at BOTH parties request. That means it is NOT public information, unless an interested party can prove to the court they have a legitimate interest in the case.

I said at the very beginning that I would not allow Singer and Mdawg to use information from this case to harm me. It was Mdawg I was most concerned with. I was almost willing to not pursue anything, but changed my mind when the attorney said he thought we had ample reason for requesting the case be sealed. No guarantees on that front, but the guy knows what he is doing and it worked out. Turns out BOTH sides wanted the case sealed for very different reasons. THAT was something we agree on before any other terms were agreed to. I don't think I can give any more details than that. Nor do I expect some will believe this.

MaxPen, I am not sure why you got involved. If you just wanted to confirm for your own curiosity, you KNOW people that know all about this case and the attorney involved. I could have even put you in touch with someone that would have satisfied your curiosity. But now I don't know what to think about you.

But thanks for screwing up a good trolling effort to have these guys on a scavenger hunt that they couldn't succeed at. I could have watched these two going on and on about "no case to be found" for months...or probably years.

And yes, there still may be info released at some point against my wishes. There was a news reporter sniffing around a couple weeks ago that contacted me. I have no idea what kind of sources these people might have to get around the system, but just the fact that she contacted me, means she got somewhere (some information). In 13 years based out of and mostly playing Las Vegas, I have run into a lot of card counters at the tables. Once I realize it I try to get away at first opportunity because it is very dangerous for 2 card counters at the same table to be raising and lowering bets in tandem. Even if their bet ramps and counts are different, bets will still be mostly raised and lowered in tandem.

So I can't say if JBJB saw me or not. He probably did. I always assumed a number of people from these forums would have seen and played with me over the years. JBJB isn't even primarily a card counter anymore, so there is a much better chance he would have seen me before I saw him.

I also don't know who or how many players have access to the databases. I am fortunate that I do. I always assumed that players playing for a living, especially that play primarily table games, would find a way to have or get access to that information at least periodically. JBJB has stated on prior occasion that he is able to see the databases.

My multiple entries are evidence that I wish wasn't there. But wishing doesn't change the facts. But I certainly would never in a million years, do anything like post that information publicly to prove something to an internet forum of people. Anyone even suggesting such a thing apparently doesn't understand what a table game advantage player like a card counter is and the relationship we have will the casinos. :confused:

If I made a claim about something and it was easy to prove with a picture I'd have no problem supporting it with a pic. Just like I tried to get Singer to do with the Newell by even offering up cash to get it done. How much you want for a pic of your oily surfboard on the beach with a "take this MaxPen" sign on it?

There are a number of things he could post that would begin to provide credibility.

He claims that he retains stacks of chips from various casinos, he's mentioned five figures, he could post a picture of his entire bankroll to prove that he has more than fifty bucks on tap, and really does retain large stocks of chips from different casinos at home, posting the pic along with a handwritten note "Hello from UNKewlJ."

He claims to live in one of the condos at Panorama Towers / The Martin on Dean Martin Dr. - although we know he has no ownership there, he could at least go up into one of those condos and post a picture showing the view while holding out his laptop or smart phone showing this page in the foreground.

He could post redacted player records that were supposedly dropped off on Halloween. The problem is - he doesn't know what such a thing looks like, so he knows trying to wing it would end badly just as it did with the backrooming matter and shuffler.

yes, I did forget about the pictures of MaxPens oddly bundled cash. And it really isn't odd at all, just looks odd. I enter most games with chips, so my first cash buy-in is after I have lost the chips I entered with. This is usually a point that the count has risen at least some, so it is not minimum bet type buy-in. At the stakes I used to play that first buy-in was $500, so I would pull a prepackaged $500 as my buy-in. If I was already at Max bet, I would pull 2 packs for $1000. That was most of my time over the past 13 years. But for the last couple years I have been playing a bit bigger amounts, so my prepackaged amount is $1000 and if I am already at Max bet, I will pull two of them. But that prepackaging as I call it is the way to go. You don't want to whip out a huge roll of $100's and start peeling some off. I forget the purpose of that post by MaxPen, but the pictures served as a good suggestion.

Now lets clear something up about this surfboard stuff. I don't own a surfboard. The last one I did own 22 years ago, was handled down to my brother when I left home. He still has it in his room, but only for sentimental reasons I guess. It is not functional. I surfed a couple days earlier in the week, with a rented board. And frankly I think those will be the last days I ever surf. Maybe it is because I haven't done it in such a long time, but it just completely wore me out. By evening I was completely wiped out. And yea it’s the wrong thread but has anyone done the math of just one of MDawgs claims? The $60k win at a 50-1 spread over 10 hours? While it’s not in Alan territory, it should be its own story in regards to how many people lost their job over it. And why he was ever allowed to enter another casino anywhere. The math says (per the Wizard) he played around 1100 hands heads up allowing for him to piss every 2.5 hours since he doesn’t drink.

So who is calculating what his average bet was, what percentage of hands he won (compared to the average of 42%) and at what limits. Did he win all the 50 times spreads? Or again, what is the math on this on average. Obviously if you win the high counts at this spread it’s possible.

So what happened after this huge win? Were the tapes looked at? Every pitboss in Vegas can count a 6 deck shoe but 2 deck is even easier. What was their excuse over 10 hours? How many were fired as we can assume their boss sold them out (10 hours, 2 pit bosses) at a minimum.

Worst case they realized they were slacking and fired them and banned the player. Best case he was a bad counter and won the small hands and lost the big ones. So what is the math on that? Possibly Alan territory there. Lose the 50 times big bets, win the small ones and still win 60k.

Of course these forums are filled with liars, but why a guy who according to his posts (Tesla, Apple, Bitcoin) is worth $50 million MINIMUM is so obsessed with KJ makes no sense.

Obviously a defect, just like KJ.

I will also answer the question about does he win all his largest (Max) bets? I think most people know the answer is unequivocally NO. If a card counter won even a majority of their largest bets, the advantage he would be playing would be far greater than a lousy 1%. The real answer is that a player doesn't even win half of his largest bets, even when the count is very high. Less than half. :(

The reason the advantage flips...ever so slightly, is because of the slight increase in blackjack at the 3:2 payoff. There are other much less important reasons like some of the double downs hit a bit more, but most of that advantage gained that allows the edge to flip ever so slightly is from a very small increase in blackjack.

But anyone who reads Mdawgs reports will have seen him say many, many times that he won the vast majority of his largest or Max bets. Again, that is just not how it work.

I can and have answered that Boz. People aren't going to believe it, so there is no sense in me repeating it a million times, but I am happy to do so for your sake, and you too can decide what you believe. Everyone has always had that right, long before this incident.

The back-rooming went down exactly as I shared. Illegal detention, arrest and back-rooming resulting in a fractured arm. NOT a compound fracture, where the bone is broke all the way through, a fracture, that heals in 6-8 weeks with a cast. I flip flopped in my mind weather to pursue anything for a couple weeks. Finally, I decided it just wasn't in my best long-term interest to do so. This is how I weigh most things.....long-term. My big concern was I was going to have to take a case all the way to trial and all my personal info would be released. And for what, a couple hundred grand, less 1/3 attorney fees.

So once I decided not to pursue anything I did share this experience, just as I always had. It was then that several players that I have a great deal of respect for, mickeycrimm, Dan Druff, axelwolf and oddly enough Maxpen, convinced me to reconsider that position. The big part of that was the suggestion that I should pursue a case to settlement rather than all the way to court. (of course you can't say that is what you are doing, you have to make it look like you are willing to go all the way).

So yes, it seems odd that a few people on an internet forum changed my mind, but that is what happened and I greatly appreciated and still do, their advice and opinions. I also heard from an AP friend not on this forum, that said the same thing. He had gone through a back-rooming case a while back.

If my initial decision would have been to pursue something I never would have said anything. So once I did change my mind, I was in trouble because I had already revealed this incident. I was out of town for a few weeks, but once the case go going with a demand letter, and negotiations, I began to see that there would be information about me and the case, that could become public. As that began to look more and more likely, I decided I could protect myself from this by announcing we had filed a case and settlement reached. That backfired spectacularly thanks to super sleuth Maxpen. I hold no ill feeling towards Maxpen for that.

It is only that last part that Maxpen was able to disprove. I actually received the settlement, which I came as close to saying an amount as I could (and it was not enough).

I can't and wouldn't even if I could, prove any of this. People can decide whatever they want and it is pretty clear they have. And that is fine with me. And if people want to decide that because Maxpen disproved part of this "ordeal" that everything I have ever said was made up.....well again, people have always had that right. I am ok with it.

If we go way way back to when I was asked what I thought about KJ's claims directly related to your blackjack play. I noted a few odd things.

I said it's very possible/probable you were just adding a few zeroes to everything. Over the years after that, I started dismissing that as being probable and started believing that you were playing the limits you claim, and you were making what you claim.
